Terms of Service

The agreement

Sparkstager is run by No Hype Labs (“we”). By creating an account or using the service, you agree to these terms and to the Privacy Policy. If you use Sparkstager for a business, you agree on its behalf. You must be at least 18.

Your account

Give us a real name and an email address you can receive mail at. Keep your password to yourself. You are responsible for what is done with your account, so tell us straight away if you think someone else has used it.

Your photos and staged images

• You keep what you upload. The photos remain yours, or remain with whoever licensed them to you.
• You own the staged images. As far as the law allows, the staged images Sparkstager generates from your photos belong to you, and you may use them in listings and marketing without paying us anything more.
• We use them only to run the service. You give us permission to store, process and display your photos and staged images, and to send them to the services named in the Privacy Policy, only so that Sparkstager can work for you. We do not use them in our marketing or to train AI models. That permission ends when you delete them, apart from backups, which expire on the schedule the Privacy Policy states.

What you may upload

Upload only photos you have the right to use: ones you took, ones the property owner or photographer allowed you to use, or ones your brokerage licensed. Do not upload anything unlawful, or photos of people who have not agreed to it.

Using a staged image in a listing

A staged image shows furniture that is not in the property. Many places require it to be labeled as virtually staged, and some require the original photo to be available as well. Following those rules is your responsibility, as the person publishing the listing. Sparkstager can mark a download for you, and Disclosing virtual staging summarizes the rules we know of. It is not legal advice.

Sparkstager is built to add furniture and leave the building alone, but images made by AI can contain mistakes. Check every staged image before you publish it, including that walls, windows, floors and fixtures are as they are in the property. Do not use a staged image to misrepresent a property.

Trial, plans and payment

• Accounts are by invitation for now. A new account starts as a founding member, with 30 photos over 30 days, and no card is needed to start it.
• Paid plans are sold through Polar, which acts as merchant of record. That means Polar takes the payment, issues the receipt and handles tax, and its own terms apply to the payment. Prices are shown in the app before you subscribe.
• A plan renews automatically at the end of each billing period until you cancel it. You can cancel at any time in Settings, under Billing. You keep access until the end of the period you paid for.
• Each period's photo allowance starts fresh. Photos you did not use do not carry over.
• Refunds are handled by Polar under its refund policy. If you think you were charged in error, email us and we will help.
• If we change the price of your plan, we will tell you before the new price applies to a renewal.

Fair use

Do not use Sparkstager to:

• get around the limits of your plan or trial, for example by opening extra accounts;
• access it by automated means, or try to break, overload or probe it;
• copy, resell or rebuild the service;
• break the law, or mislead buyers, renters or anyone else.

We may suspend or close an account that does. Where it is reasonable, we will warn you first and tell you why.

The service

We work to keep Sparkstager available and correct, but we provide it as it is, without a promise that it will always be available, free of errors or right for your purpose. We may change or remove features. If we stop offering the service, we will give you reasonable notice so you can download your images.

Liability

As far as the law allows, we are not liable for indirect or consequential losses, such as lost sales, lost commissions or a complaint about a listing. Our total liability to you for any claim is limited to what you paid us in the 12 months before it. Nothing in these terms limits liability that the law does not allow to be limited.

Ending

You can stop using Sparkstager at any time. To close your account and have your photos removed, follow Closing your account in the Privacy Policy. If we close an account for breaking these terms, we will tell you and, unless the law prevents it, give you the chance to download your images first.

Law and disputes

These terms are governed by the laws of India. The courts at Chennai, Tamil Nadu have exclusive jurisdiction over any dispute about them. Please contact us first. Most problems are quicker to fix by email.

Changes to these terms

When these terms change, the date at the top changes with it. If a change matters to how you use Sparkstager, we will tell you in the app or by email before it takes effect. Using the service after that means you accept the new terms.
